What types of common title issue can arise?

When people in Houston purchase property, they want to know that the property is completely theirs. The only way to ensure the property belongs only to them is to receive clear title on the property. However, properties in Houston can suffer from a variety of title issues that bring the person's ownership into question. When a property has title issues, real estate disputes can arise. If more than one party lays claim to a property, disputes over who really owns the property and how the property can be used might occur.

There are several ways that title can be clouded when it comes to real estate. First, there may be past ownership claims. In these situations, it may not be clear who the original owner of the property was. Therefore, many individuals may lay claim to the property rights. In this case, any one of these individuals may bring legal action to claim the property is actually theirs.

Additionally, there can be liens against the property. A lien typically results from an unpaid debt. A lien prevents a property owner from selling the property without paying off this debt first. If a property is subject to that lien, a property owner needs to pay off this lien before being able to transfer the property.

Finally, covenants can burden the title of a property. A covenant occurs when the original homeowner made a promise to someone else. This could include the promise that another neighbor can cross or use the land in some way. These covenants can affect new owners of the property for many years to come.

It is important for individuals to understand whether or not they own property with clear title. If the title has issues, real estate disputes can arise. An attorney can give specific legal advice on how to clear title and how to address real estate disputes.
