The importance of establishing paternity for unmarried fathers

There are few occasions in a man’s life more incredible than the birth of their child. Everything changes when you’re holding that tiny bundle in your arms.

What if you discovered that you have no legal rights regarding that child? How would that make you feel? That’s the reality for many unmarried fathers.

The legal significance of paternity

If you and the child’s mother are in a relationship, it may not seem like a big deal if your name isn’t listed on the birth certificate. However, paternity is the foundation that unlocks several parental rights, such as:

  • Custody and visitation arrangements: If you and your partner separate, the courts can’t consider your requests for time with the child without first establishing that you are the legal father.
  • Decision-making authority: You can participate in major choices regarding your child’s life, including education, healthcare and religious upbringing
  • Financial rights and responsibilities: You can contribute financially to the child’s well-being. You also gain the right to seek monetary support from the mother if you have primary custody.
  • Inheritance rights: Your child can inherit from you, even if you don’t have a will, and they may be eligible for benefits like Social Security survivor benefits if something happens to you.

There are three main paths to establishing paternity. The simplest method involves signing an Acknowledgment of Paternity (AOP). Both parents must voluntarily sign this document, which legally establishes you as the father without going to court. This can be done at the hospital when your child is born or by contacting an AOP-certified entity.

Suppose there is uncertainty regarding the paternity, or there is some dispute, such as the mother refusing to sign the AOP. In that case, the court may order DNA testing to establish the biological relationship.
